Rules and Requirements to be Observed when Requesting Authorization to Pay Wages Below the National Minimum Wage

Executive Decree no. 179/24 of 10 October was published, approving the Regulations for the Procedure and Requirements for Authorization to Pay Wages Below the National Minimum Wage.

Under the terms of the aforementioned Decree, Micro, Small and Medium-sized Enterprises that demonstrate temporary financial incapacity to pay the National Minimum Wage may apply to the Ministry of Public Administration, Labor and Social Security (MAPTESS) for authorization to pay a lower wage. To this end, interested employers must be legally registered on the MAPTESS Digital Platform or Portal and provide documentary proof of their financial incapacity. 

According to this law, the authorization to pay wages below the National Minimum Wage is valid for a period of 12 (twelve) months and can be extended once for the same period.
