Synopsis of August

PRESIDENTIAL DECREES

PRESIDENT OF THE REPUBLIC


  1. Presidential Decree no. 179/24, of 01 August (came into force on the date of its publication) - Approved the Regulation on Licensing for the Exercise of Occupational Safety, Hygiene and Health Services, which establishes the rules governing the creation, organisation and operation of occupational safety, hygiene and health services in companies and other organisations covered by the General Labour Law. In order to set up occupational safety, hygiene and health services, the employer can opt for one of the methods provided for in the law, namely internal, inter-company or external services. To provide occupational safety, hygiene and health services, companies must apply for authorisation or registration, in the case of external or inter-company services, respectively, with the General Labour Inspectorate (IGT). In addition to the legal requirements for providing occupational health and safety services, applicant companies are subject to prior assessment. The certificate authorising the provision of occupational safety, hygiene and health services is valid for 3 (three) years. Failure to comply with the rules set out in the regulation is an administrative offence and is subject to a fine ranging from 10 to 150 national minimum wages.

  2. Presidential Decree no. 180/24, of 01 August (entered into force on the date of its publication) - Approved the Programme for the Improvement of Luanda's Urban Mobility, abbreviated to ‘PRO-MMUL’. PRO-MMUL will be implemented in two phases: a) The first refers to projects that are able to start immediately and includes the construction of the Luanda Railway Fence (CFL), the Luanda Surface Metro (ZEE - AIAAN - Zona Verde - Engineering section), the BRT (Bus Rapid Transit) System (Estalagem, Kilamba and KK5MM sections) and 5 Overground Stops; b) The second, which will start in 2025, includes projects that need further study and funding, namely the construction of 9 overpasses on the CFL and the Luanda Surface Metro (Zona Verde - Sequele - ZEE - AIAAN section.

  3. Presidential Decree no. 188/24, of 22 August (entered into force on the date of its publication) - Approved the Land Identification Number Regime, which establishes the rules and procedures for setting up, assigning, transferring and extinguishing the Land Identification Number (NIP), as well as the models for certificates, registrations and changes to land registry data for urban and rural properties, applicable to all properties throughout the country, regardless of their legal status or purpose. The NIP aims to identify every building in the country and ensure uniform management of land registry data. It is a code based on geographical references, made up of 14 digits and divided into 5 (five) groups. The NIP is assigned by the Central Cadastre Service and can be extinguished by the total destruction of the building or by the merger of two or more contiguous registered buildings;

  4. Presidential Decree no. 189/24 of 22 August (will come into force in November 2024) - Approved the Regulation on the Registration of Storage Facilities, which establishes the fundamental principles and rules to be observed in the registration of storage facilities, applicable to all existing storage facilities throughout the national territory, with the aim of ensuring proper control and supervision of these infrastructures, promoting compliance with the law and protecting the integrity of the products stored. The law establishes a set of principles by which the registration of facilities must be governed, namely universality, officiousness, obligation and uniqueness and single enrolment. The entity responsible for registering storage facilities is the Angolan Cargo and Logistics Certification Regulatory Agency (ARCCLA). Applications for registration by interested parties must be submitted to ARCCLA by filling in the electronic form, which should be available on the Agency's website.


PRESIDENTIAL DISPATCHES

PRESIDENT OF THE REPUBLIC


  1. Presidential Order no. 194/24, of 23 August (entered into force on the following day of its publication) - Authorised the privatisation, through an Initial Public Offering, of the shares held by the State, through Unitel, S.A., representing 15% of the share capital of Banco de Fomento de Angola, S.A., and delegates powers to the Minister of Finance, with the right to sub-delegate, to verify the validity and legality of subsequent acts within the scope of the respective Procedure;

  2. Presidential Order no. 195/24, of 23 August (entered into force on the following day of its publication) - Authorised the privatisation, via an Initial Public Offering, of shares representing 15% of Unitel, S.A.'s share capital, authorised the reservation of 2% of the shares for acquisition, under special conditions, by employees and members of the company's governing bodies, and the delegation of powers to the Minister of Finance, with the right to sub-delegate, to carry out the decision-making and tutelary approval acts, as well as to verify the validity and legality of all subsequent acts within the scope of the aforementioned Procedure.


LETTER

PRESIDENT OF THE REPUBLIC


  1. Letter of Ratification no. 14/24, of 19 August (entered into force on 23 August) - The President of the Republic declares the Treaty Establishing the African Medicines Agency (AMA) between the Member States of the African Union to be firm and valid and guarantees that it will be strictly observed;

  2. Letter of Accession no. 4/24 of 19 August (entered into force on 23 August) - The President of the Republic gives firm and valid assent to the Salamanca Declaration on Principles, Policies and Practices in the Area of Special Needs Education and guarantees that it will be strictly observed;

  3. Letter of Approval no. 7/24, of 23 August (entered into force on 27 August) - The President of the Republic signs as firm and valid the Agreement between the Government of the Republic of Angola and the Government of the Russian Federation on the Constitution and Conditions of Operation of Informative-Cultural Centres and guarantees that it will be strictly observed;

  4. Letter of Approval no. 8/24, of 23 August (entered into force on 27 August) - The President of the Republic declares firm and valid the General Cooperation Agreement between the Government of the Republic of Angola and the Government of the Republic of Malawi in the Economic, Social, Technical, Scientific, Cultural and Political fields and guarantees that it will be strictly observed.

RESOLUTION

NATIONAL ASSEMBLY


  1. Resolution 83/24, of 16 August (entered into force on the date of its publication) - Approved the recommendations resulting from the presentation of the Report on the Implementation of the General State Budget for the Third Quarter of the 2023 Financial Year. The report succinctly demonstrated the results achieved and with an impact on the social and economic level during the execution of the State Budget by the various bodies throughout the third quarter of 2023, namely, the unemployment rate fell to 29.6 per cent, compared to 32.9 per cent in 2021, in terms of the PIP, around 53 projects were completed with 100 per cent physical execution, among others;

  2. Resolution 84/24 of 19 August (entered into force on the date of its publication) - Approved the Regulations of the Commission on Human Rights, Citizenship and the Environment (10th Commission), a permanent body of the National Assembly that ensures parliamentary activity in the promotion, protection and defence of citizens' rights, freedoms and guarantees. The statute lays down the rules on the organisation, composition, competence, rights and duties of the members and how it operates. Its competences include examining drafts and proposals for laws, draft resolutions, proposals to amend diplomas and treaties submitted to the National Assembly, whose subjects are linked to the area of human rights, citizenship and the environment, and producing the corresponding reports and opinions;

  3. Resolution no. 85/24, of 20 August (entered into force on the date of its publication) - Approved for ratification the Agreement between the Republic of Angola and the Republic of Rwanda for the Elimination of Double Taxation in Income Tax Matters and the Prevention of Tax Evasion;

  4. Resolution no. 87/24, of 20 August (entered into force on the date of its publication) - Approved for accession by the Republic of Angola Convention no. 190 on Violence and Harassment, designed to promote the implementation of international labour standards.


INSTRUCTIONAL

NATIONAL BANK OF ANGOLA


  1. Instruction no. 07/24, of 15 August (came into force on the date of its publication) - Approved the Electronic Money Accounts Regime. This Instruction establishes the different types of electronic money accounts, as well as the rules and procedures for opening and operating them. Accounts can be Type I, II, III, IV and V, depending on whether certain information is required for opening the account or permissions for operations/movements on the accounts. The maximum transaction limits for e-money accounts will be defined by Banco Nacional de Angola in specific regulations. Accounts can be closed at the request of their holders or legal representatives, or at the initiative of the payment service provider.
